Movies Under the Stars

It was a beautiful Saturday night.

What could be better than a picnic dinner in the park followed by a great movie.

The City of Walnut Creek was holding a "Movies Under the Stars" event and of all things they were showing one of my favorites.

Picture 2,500 of your closest friends family and neighbors all in their blankets and sleeping bags.

It's like a giant slumber party.  Everyone has a great time!

I was talking to one of the technicians and the next movie will be Shrek 3!

Smoke getting in your eyes?

If you are anywhere in Northern California it might be. 

Do we really have over 1,000 individual fires going right now?

CalFire You've seen Google Maps.  Did you happen to notice the little feature called "My Maps"?

With My Maps you can create and annotate pretty much anything on a Google Map and then share it with anyone else.

My motorcycle buddies will use this to share a planned riding trip amongst ourselves.  We can then send the map to our wives via email so they know where we are going.

I think the California Governor's Office of Emergency Services has been spying on us.  They' are using the same feature to give updated and accurate information to virtually anyone, anywhere.  Here's their Google Page with all their maps.

The Mystery Plays

I know this article is a departure from the typical Mortgage and Real Estate, but like all mysteries it has a twist at the end (a Real Estate Twist!).

The Mystery Plays Friday night, my wife and I had the pleasure of attending a small community theater performance.

The play was at the downtown Walnut Creek Theater, The Lesher Center for the Arts in the small and intimate "Knight Stage".

I'm not a theater goer - maybe a couple a year if I'm lucky.  My wife on the other hand has a deep association having been a stage manager for many years.  She's also one of those people who read mystery novels (at least one a week), so this was right up her alley.

I don't want to give away the plot but this much I can tell you.   One play, two stories, somewhat connected.  You'll be sitting on the egde of your seat for some very intense parts played by some very good actors. 

Speaking of Actors...

Lynne Elizondo, Ryan Terry, Beth Bemis, John Hale, Sean Bryan and Bill Clemente all did an excellent  job.  This was Directed by John Allred, but unlike other plays that I've been to, he was there, working to make sure everything was just right.

I'm not sure if it was the intimate setting (small wrap around theater), or the intensity of the performance, or a combination of both, but the play really worked!  Can I step off my Mortgage soapbox for a moment and suggest you see this play?  You bet!

Why Not Feel Good?

Saturday, I was invited to pop in to an open house being held at Security Pacific in Walnut Creek.

secpac1This wasn't in one of their Listings but an Open House of their Office.  It was Client Appreciation Day!

Past Clients, Future Clients, (and even loan guys like me) were invited to come and spend a little time with our favorite Agents.

Sec Pac provided all the goodies too.

Hamburgers, hot dogs, cotton candy, soda and brownies. 

It worked, the people came and the conversation and smiles flowed!

secpac3 Not to stop there, they combined this all with

  • E-Waste Recycling,
  • Cell Phone Recycling,
  • Free Shredding Service,
  • Eye Glass Donations,
  • Massage Therapy (really!  Right there in the front lobby)
  • and even a Raffle!

The only thing I didn't see was a recycling bin for my aluminum can - (maybe I didn't look hard enough)

It was a beautiful day and the smiles and friendship made my day even better!

Local E-Waste Recycling Helps School

Our local High School, Ygnacio Valley High is sponsoring an E- Waste recycling event this weekend.  

This is a fund raiser for the Y.V.H.S. Music Boosters.

The event is absolutely FREE! 

There's No Limit to the amount you can bring. 

They'll be open Saturday and Sunday from 9:00 AM to 3:00 PM.

DID YOU KNOW?

If you took your average sized monitor to the local dump they will charge you anywhere from $35 to 50 dollars per piece just to dispose of it.  (they can't just bury it in the landfill)E-Waste 013

The actual recycling is done by a professional company          www.UnWaste.com 

They gather, crush, shred, and then sort the material.  The heavy metals are separated, anything that can be (like the plastic) is recycled, and there is even small tiny bits of gold that your E-Waste contains.  Go ahead and just try and get that out!

 

IT'S CALLED A BENEFIT FOR A REASON

While the event is FREE, our kids would appreciate any donations - every dollar you donate goes directly to the kids music programs!   Let's just say with the recent budget cuts, they really need it!

Your donation is also tax deductible

The Music Booster Organization carries a 501(c)(3) designation  - just ask for a receipt!

Citigroup "Global Community Day"

Saturday, November 17th: Over 58,000 volunteers participated in over 1,000 projects in more than 450 cities across 100 countries.

Really? That's the line from the Citi issues press release. Does that mean it really happened? I can't say. Is this just another large company pumping out pseudo propaganda in an effort to bolster it's image? Maybe.

I tend to be a little cynical when it comes to the big guys. Instead of throwing out wild accusations I'll report on what I actually witnessed.

The stage was set. Saturday at dawn, we were to meet at down at the old High School. The Kids were warned. The Parents and Teachers were notified. Would Citi even show? Only time would tell.

The plan was to band together to clean up the school. 55 Acres, 1,500 students, 2 district paid Custodians during the day. Outnumbered.

"If a piece of paper falls to the ground, and no one is there to pick it up, does it make a sound?"

Well... We brought our kids, our parents and teachers. Citi did show up. They showed up in spades! They brought Bank Managers (yeah Scott Sachs!), Tellers, Administrators, Personal Bankers, and even the Securities Guys! They even brought Breakfast and Lunch! We banded together with the Citi employees, separated into groups and went to work.

We picked up trash. We steam cleaned. We pruned. In the end, we made a real difference. We also learned along the way that sometimes it's not all about the company.

Financial statements , Dividends and Stock Prices all have their place in the world. But sometimes it's bigger than that. Sometimes it's all about the people.

Ygnacio Valley H.S. Marching Band

I'll be a "Band Dad" again this weekend. 

The Ygnacio Valley High School Marching Band will be loaded and on the Bus before dawn Saturday.

They'll be marching in beautiful Napa Valley in the Vintage Reserve Band Festival.  They are a small but wonderful group of kids.   I just hope it doesn't rain.

Last weekend they finished FIRST in the Lodi Grape BowlGo Warriors!

That's No Moon...

Back in 1977 I was sitting in the front row of the local theater watching Obi-Wan as the Millennium Falcon came out of hyperspace and discovered a debris field where a planet should have been.

Oh and then there was this strange looking Moon...

This morning I can't help but think that we in the mortgage industry are like some of the characters in StarWars.

Today I was told that Diablo Funding, one of Northern California's largest brokerages will shut it's doors Tuesday. I had heard the rumors a week ago, but today it became official!

They are closing due in part to "buybacks". Meaning that they are having to buy back loans they brokered to wholesale lenders.

Here's the cliff notes version as I heard it through my sources. A Large Wall Street Firm that owns multiple wholesale lenders, one of them being a bankrupt subprime lender, requested that some (not all) of the loans they had funded through them be re-purchased by Diablo. This would be a very large capital expense for any business to take on. Not surprisingly, Diablo refused. So the Large Wall Street Firm then instructed all the other branches of it's lending network (the A and Alt A paper lenders) to not fund any loans originated by Diablo - period!

Diablo also operated under the department of corporations and had unlicensed loan officers working under supervision that are off the radar.

Y.V.H.S. E-Waste Recycling Success!

E-Waste 004 It's Blog Action Day and it came at just the right time. This weekend we helped with the Ygnacio Valley High School Electronic Waste / Recycle Event. I am happy to report that it was a success!

In case you missed it - the parking lot at the high school was turned into a giant drive through recycling center for all items that shouldn't go to the landfill.

The event was a fundraiser for the YVHS Music Department. As you might guess, the Music Programs have all had serious funding issues lately with little chance of a brighter future. Since the Feds and State are cutting back - fund raisers like this will become more critical in the near future to the continuation of the entire music department.

E-Waste 006 While the heavy lifting and sorting was left to the professionals, the kids were allowed to explain the program, accept donations and talk with the public.

Here's a couple of interesting factoids:

E-Waste 018If you were to drop off a TV or CPU at the local landfill, they would charge you $25 to $40 per item. The dump cannot treat these items like normal rubbish - they must collect and turn it over to a proper e-waste recycling company. That company crushes the items - then sorts and separates out the raw heavy metals.

Everything is crushed - nothing is reused. To the horror of the kids - if someone were to drop off a brand new in the box iPod - it would be crushed! No questions asked. This is part security, part business. If I was to drop off a CPU I wouldn't want to see that Hard Drive reanimated into a newly refurbished computer with all my important private information on it.

Free Electronics Recycling

 E-Waste - It's all those things you can't just toss in the garbage.  It's computers, it's cell phones, it's printers, scanners, even you mouse!

Here's your chance to get rid of those pesky old tech gadgets piling up in the garage.

    Lease Option to Buy Snag

    home1From a Sellers perspective the Lease Option could be viewed as a viable method of moving the property from the negative side of the equation to the positive  side.  If a home is on the market it obviously has no rental income, it's also not benefiting the present owners by providing a roof over their heads.  As it sits on the market it's costing the seller each and every day.  They probably have to wait to make an offer on their new home until they have an offer on their present home.  One of the latest tactics when a home doesn't sell is to Lease Option it.  I wrote about one such instance here:

    This tactic could be a win for the Seller depending on the structure of the deal.  Many deals are structured to favor the Seller, not the Buyer.  Not that there couldn't be a Win - Win for both, I just happen to see more tilted towards the Seller.  That makes some sense as they are the ones writing the contract. 

    For the potential Buyer, there are certainly risks involved. 

    Lease Options are nothing new.  Rent to Own business models are known to all.  I could go down to my local Rent - A - Center and pick up a new leather couch.  Exorbitant rental fees aside, I now am watching my Rent to Own Plasma, while sitting on my Rent to Own couch.  If I miss my weekly payment, they come pick up my TV and couch and I'm back to where I started.  If I continue my payments to the end, I now own the couch and TV.  It's all good.

    Lease Option the house and I will probably put something down as a deposit, I'll have to make my monthly rent on time each and every month, and then 2 years later a portion, or maybe all of my rent is applied towards the purchase price.   It's all good.

    Almost.

    • What happens if the market zooms in those 2 years?
    • What if it declines?
    • What will rates be like in June 2008?
    • Will his credit be any better then?
    • What will underwriting guidelines be like in June 2008?
    • Will he be able to qualify for anything at all?

    These are just the reasonable questions we can ask.  The foreseeable ones.

    But remember, there's a reason the house wasn't sold to begin with.  Was it overpriced?  Was it below standards?   Did the owners need money?  There was a reason.

    This presents another risk to the Lease Option Buyer.  What if the Owner / Seller goes under?  What happens if the home goes into foreclosure?  When you signed the agreement, did you ask for financial statements from the Seller?  Did you check to see if there were any liens on the property?  Of course not.

    Lease Options can be good vehicles to move property.  But increasingly there are more and more reports coming out as good Lease Options go bad.

    Don't Worry

    My good friend and highly ethical mortgage professional, Tony Gallegos shared a video he found on YouTube.

    As he writes on his blog The Mortgage Cicerone,

     "Bottom line - It's BOZO's like Richard and friends that hurt our industry. Can you imagine being so proud of these sales tactics that you actually post it on YouTube?"

    Personally, I liked the voice in the background, "Hi, I'm calling you on behalf of your current lenders wholesale department..."

    We, the true mortgage professionals, know these people exist.  We fight their mis-information and unethical practices each and every day.  Does the poor homeowner know who they are talking to?  Not a chance. 

    These people exist and they are numerous.  I had an office right next door to me, now thankfully out of business.  But there's still plenty of scum out there.  I had a client just yesterday come to me who had been dealing with these guys.

    Remember, this is only a small snippet of what they do.  Don't work with telemarketers.  Don't work with people you don't know.  Don't work with someone hundreds of miles away.  Only work with a True Mortgage Professional!  If you don't know one - ask me! 

    I referred a Wells Fargo Mortgage Loan Officer to two highly ethical people I trust in Florida this week.  Imagine that, a loan officer calling me, to do a refinance on her home, because she didn't want to work with anyone in her company or with someone like Robert.  Smart move if you ask me.

    FHA is not Fannie Mae

    "Borrowers with subprime loans are now ending up in foreclosure twice as often as borrowers with FHA-insured loans, said Brian D. Montgomery,  tricycleassistant secretary for housing and the federal housing commissioner for HUD.

    Of the 10 states with the highest percentage of FHA-insured loans, only three (Texas, Indiana and Utah) also rank among the top 10 for foreclosures, new federal data show. The FHA's current strong position follows a sharp dip in its market share. Between 1996 and 2006, the FHA's share dropped 25 percentage points, from 32% to 7%, among minority borrowers, the same class of borrower that (according to the Center for Responsible Lending) provided the single-largest rush into the subprime mortgage market.

    The GAO report linked the drop in FHA's share of the overall mortgage market to the popularity of adjustable-rate mortgages and other unconventional loan products generally disallowed in the FHA program, and the hassle of filing the paperwork to do an FHA loan.

    Many originators found the fees on interest-only and zero-down payment loans, which the FHA won't insure, higher than with government loans. In an interesting footnote, the National Association of Mortgage Brokers told GAO that many of its members couldn't afford to meet the FHA's financial requirements for brokers writing FHA-insured loans: a brokerage business must have a minimum net worth of $63,000 and provide annual audited financial statements. "

    While this is the National story, the local or Bay Area spin is that FHA (and it's loan limits) will not work with so many of our local loan amounts. 

    Fees aside, financial requirements aside.  FHA will work for the 1 Bdrm Condo in Bay Point or Oakland, but it won't work for the 4 bdrm Rancher in Walnut Creek.  The loan amounts are simply too high.  The same can be said for VA.   FHA has some great programs and really can do some great things.

    The buzz in the media these days seems to be "FHA, It's your answer to the subprime collapse" .

    The truth is, while that's correct it just doesn't apply to the bay area for so many situations. 

    Remember, a Conventional, Conforming Fannnie Mae (or Freddie Mac) loan is capped at $417,000.  Anything above that falls into a Jumbo Loan. There's plenty of loan programs that will do that.

    FHA is not Fannie or Freddie.  The two are completely different, not connected.  There is no Jumbo FHA.

    Pleasant Hill 4th of July Parade

    tipsytheclown Sometimes things reach down into my soul and touch me. 

    Yesterday was one of those times.

    Every year we go to the big Parade in downtown Danville.

    This year, because Mr. Howard was the Pleasant Hill Chamber of Commerce Educator of the Year, we went to the Pleasant Hill Parade

    We sat in the shade. We waved flags.  We saw clowns,cheerleaders, Boy and Girl Scouts. 

    We watched, we cheered, and laughed.

    That was all on the outside.

     

    On the inside, deep down inside, something else was happening.

    I didn't realize it at the time.  We were getting all warm and fuzzy. 

    I'm still trying to put a finger on it but I believe it's all about connecting and feeling connected to the community.

     

    Nearby, the town of Danville has an estimated 50,000 people watching their parade.  I've been there, I've seen that.

    Danville has much better cars, much better marching bands, and professional looking floats. 

    In being too big, does it also lose part of it's hometown soul?

    It does for me.  But I didn't realize it until yesterday.

     

    cheerkidNot once while sitting on the sidewalk has my Daughter ever recognized someone.  Yesterday that happened over and over and over again.

     She even jumped into the street, hugging a bunch of girls she knew that were with a swim team and even marched a bit with them! 

    Homeland Security didn't sweep in and arrest her - this was a hometown parade. 

    This is the heart of the charm.  This is what community is all about.

     

    Using this example and applying it to real estate -

    • We all want to feel like we are part of the community. 
    • We prefer to work with people in our community.
    • To buy a home in Pleasant Hill would you want to use an Agent in San Francisco?  No, You'll use an Agent in the community.
    • When you want to sell your home in Pleasant Hill, you'll want to list it using an Agent from Pleasant Hill.
    • Community is the glue that gives us comfort, it binds us all.

    Better yet, next year I'll be IN the Pleasant Hill Parade!

    Keeping You In


    I read an article in the WSJ that was about how banks are working to keep you.

    Customer Retention's the name of the game.

    For some reason I cannot link to it so here's a cut and paste.


    Best part is at the bottom (isn't it always), LendingTree is promoting a $500 price guarantee.

    That sounds great. Then you read the fine print...

    • It's only for fixed rate mortgages
    • It's only for Conforming Loans ($417,000 max)
    • Oh yeah and you as a borrower have to document that you received a better offer from another source on the same day as the application was submitted to LendingTree.
    • And you have to close on that offer.
    This is such great fodder for another day but...
    You have to understand Lending Tree's business model.

    They are a referral generating lead source.
    They advertise, advertise, advertise.
    Then if they did a good enough job on their commercials,
    they'll get a stream of applications coming in.

    But "Oh - Oh" you say, "Lending Tree doesn't do loans".
    That's part right! They are in the Lead Selling business.
    They will then sell your good name to no fewer than 4 brokers or lenders.
    Typically they'll sell you for around $500 to each one.

    The other part, the part that's wrong, is that they do indeed do loans.

    If I just spent $500 to get your name, address, and credit scores, how accurate do you think my Good Faith Estimate is going to be to you?

    So if I'm buying leads from Lending Tree, and I'm quoting rates that are "not so realistic" just to get you to bite on my hook, how in the world is anyone going to beat my offer?
    How can LT lose?

    That's right, they can't.
    And even if they did, it's such a good marketing gimmick that they just don't care.

    They mention that one guy did submit a claim.
    His loan was only for $100,000 - which is pretty petty,
    meaning chances are none of the Lending Tree lead buyers really cared too much about winning that one.

    Oh, and anytime LT wants to crank up the profits, all they have to do is start selling your name to 5 or 6 lenders instead of the 4.

    Of course they'll paint that as a positive, "Now you'll get up to 6 offers from banks, because when banks compete, you win!" - NOT!

    Just remember, in anything you do...
    Know who's selling you what, and where they're coming from.
    You have to know their angle.

    Get a mortgage from another lender and we will pay you $250.

    That is the latest marketing twist from Bank of America Corp. With competition for home loans increasing, the Charlotte, N.C., lender is encouraging its customers to apply for a mortgage with the bank and then shop around. If they decide to get their home loan elsewhere, Bank of America will write a $250 check to cover a portion of their closing costs.

    The Bank of America offering is the latest sign some lenders are beginning to emphasize price, service and stronger customer relationships in the face of slowing loan volume. Mortgage originations fell 29% in the third quarter compared with the same period last year, according to the Mortgage Bankers Association, as the housing market cooled and rising interest rates made it less attractive for borrowers to refinance.

    Last week, Charles Schwab Corp. said it would give most of its bank and brokerage customers a 0.25 percentage point discount on the rate for a new adjustable-rate mortgage or home-equity loan and a 0.125 percentage point discount on the rate for a fixed-rate mortgage. Until now, the discounts were available only to clients who had combined bank and brokerage account balances of more than $250,000.

    In August, E*Trade Financial Corp.'s mortgage unit began offering $500 off mortgage closing costs to the company's banking and brokerage customers who have less than $100,000 in total assets at E*Trade. E*Trade customers with assets of $100,000 or more get a 0.125 percentage point mortgage-rate discount.

    Other lenders are using rewards programs to try to boost customer loyalty. National City Corp. (my old company, - mm) gives customers enrolled in its rewards program 50,000 bonus points when they take out a mortgage with the bank. Customers also earn bonus points for tapping a new home-equity line of credit. Citigroup Inc. offers special reward points to customers with a Citibank mortgage or home-equity loan, provided they also have a Citibank checking account and debit card. The points can be redeemed for a variety of rewards, from gift cards to plane tickets.

    The offers represent a new tactic for lenders, which for years vied for customers by rolling out mortgage products that allowed borrowers to lower their monthly payments. These include interest-only mortgages that allow borrowers to pay interest and no principal in the loan's early years, option adjustable-rate mortgages that let borrowers make a minimum payment but can lead to a rising loan balance, and mortgages with 40-year terms. But the flow of new products has slowed and bank regulators have raised questions about the risks some nontraditional mortgages may pose to borrowers and lenders.

    Some lenders are wooing customers with pricing guarantees. LendingTree.com, a unit of IAC/InterActiveCorp, is offering a $500 price guarantee to certain borrowers who use its loan network to shop for a home mortgage. The offer, which runs through year end, applies only to borrowers taking out standard fixed-rate mortgages for $417,000 or less. To qualify, borrowers must document they received a better offer from another source on the same day an application was submitted to LendingTree, an online service that matches borrowers with lenders. LendingTree will pay the $500 if it can't get one of its partners to meet or beat the offer. So far, only one customer has put in a request for the $500 payment, but the request was declined because the loan was for less than $100,000, the company said.

    Bank of America's "Best Value Guarantee" program is designed to attract borrowers who think they would get a better deal from a mortgage broker or another competitor. To qualify for the payment, customers must have a checking, savings or other account with the bank, apply for a mortgage and then provide proof they obtained the home loan elsewhere. During the pilot tests, only a handful of bank customers claimed the payment, said Senior Vice President Eric Telljohann. The offer is being rolled out in a number of East and West Coast markets and should be available nationwide by January, the bank said.

    Note from Mike: Report after report from the Mortgage Brokers and the mortgage bankers groups have repeatedly shown that the borrower will generally save more money by going through a broker than by going directly to the source. While BofA's "Best Value" is once again a wonderful marketing slogan, it doesn't hold water to the facts.
